1. Service Description

The Platform provides a digital engagement service where users can submit non-binding wishes to participating venues.

A wish is a suggestion only. A wish does not create a guaranteed right to playback of any specific song, track, or content.

2. No Music Distribution

The Platform does not host, stream, distribute, or provide music content.

Any content played inside a venue is selected and controlled independently by that venue and its own systems.

3. Venue Responsibility

Each participating venue is solely responsible for compliance with copyright, public performance, neighboring rights, and any local music licensing rules that apply in that jurisdiction.

4. No Guarantee of Playback

Submission of a wish or use of a wish boost does not guarantee playback, order, or timing of any content.

Venues retain full discretion over all playback decisions.

5. Nature of Wish Credits

Wish credits are digital engagement tokens. They can be used to increase visibility or priority of a wish inside the venue interface.

Wish credits do not represent a purchase of music, ownership of content, or purchase of any playback right.

6. Pricing, VAT, and Payment

  • Prices are shown before checkout.
  • Where required by law, displayed prices include VAT or equivalent consumption taxes.
  • For EU consumer transactions, VAT treatment follows destination-based digital service rules.
  • Payments are processed by third-party payment providers. You must provide valid payment details and authorization.

7. Right of Withdrawal (EU Consumers)

If you are an EU consumer, you may have a statutory 14-day withdrawal right for distance contracts.

When you explicitly request immediate performance of digital services and acknowledge loss of withdrawal right after performance starts, withdrawal can be unavailable once the service has begun.

8. Refund Policy

Wish credits are generally non-refundable after use because they are digital items consumed in-service.

This does not limit mandatory rights under applicable consumer law, including remedies for non-conforming digital services.

9. Acceptable Use

  • Do not abuse, disrupt, reverse engineer, or attempt to bypass security controls.
  • Do not submit illegal, hateful, threatening, or otherwise unlawful content.
  • Do not use stolen payment methods or fraudulent identities.

10. Suspension and Termination

We may suspend or terminate access where required for security, fraud prevention, legal-compliance enforcement, or material Terms violations.

11. Limitation of Liability

The Platform is not liable for actions, decisions, playlist choices, or content selections made by participating venues.

Nothing in these Terms excludes liability that cannot be excluded under mandatory law.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Croatia, without prejudice to mandatory consumer protections in your country of residence.

Before court action, parties should first contact support to attempt resolution. Consumers may also use applicable ADR channels in the EU.

14. Changes to These Terms

We may update these Terms from time to time. Material updates will be posted with a new "Last updated" date and may require renewed acceptance where legally required.
